To the worshipful, the Justices of the Court of Please and quarter Session for Williamson County, April Session AD 1825.
Your petitioners Martha White widow, relict and device of Chapman White deceased and William White, Abram White and also Lucinda M. White and Moses White which two last sue by their guardian the said Martha White as they are minors, which William C., Abram, Lucinda and Moses are children heirs at law and devices of the said Chapman White deceased and Moses C. Ragsdale, Elizabeth Ragsdale, Martha Ragsdale, Martha W. Ragsdale, Catherine M. Ragsdale, Henry Ragsdale, Robert Ragsdale, William Ragsdale and Edward Ragsdale children and heirs at law of Edward Ragsdale deceased who sue by their guardian Spencer Buford as they are minors. Respectfully we present that the said children and heirs at law of Edward Ragsdale deceased are together entitled to a tract of land situated in the county of Williamson . . . containing five hundred and eighty four acres and three parts that the said heirs of said Edward Ragsdale are entitled in fee siimple to two hundred and sixty four acres of the said tract to be divided according to quantity and quality, and the devices and heirs of the said Chapman White are entitled in fee simple to the remaining part of the said tract according to the provisions of the said Chapman White's will and as the said parties interested and desirous to have the said tract of land divided so as to allot to the said heirs at law of the said Edward Ragsdale two hundred and sixty four acres thereof according to quality and quantity of the whole, and the remaining part thereof to the said heirs at law and devices of the said Chapman White deceased, they therefore pray your worships to appoint five commissioners to make partition of said tract of land in such was as to allot to the said heirs & devices of the said Chapman White and the said heirs of the said Edward Ragsdale their respective parts as aforesaid and that they make return of their ________ to the next term of this Court. And your Petitioner will ever pray.

Notes from the estate of of Penelope Ragsdale
Williamson County, TN - 1850

To the Honorable Chancellor of the Middle District of the State of Tennessee holding the Chancery Court at Franklin.

The Bill of complaint of William White administrator of Penelope Ragsdale dec'd and of Henry Ragsdale, Robert Ragsdale, Edward Ragsdale and Catherine Ragsdale of the county of Williamson in the State of Tennessee against William Ragsdale of the county of Fayette & State of Tennessee and Moses C. Ragsdale, Coldwell P. Pool and Elizabeth Pool his wife and ________ of the State of Mississippi and George D. Norris and Martha Norriss his wife of of the State of Alabama defendents.

Humbly your complainants show unto your Honor your orater the said William White administrator of Penelope Ragsdale dec'd and Henry Ragsdale, Robert Ragsdale, Edward Ragsdale and Catherine Ragsdale that many years since one Edward Ragsdale dec'd departed this life intestate in the County of Williamson leaving his surviving widow Penelope Ragsdale since deceased and his children your orators Henry Ragsdale, Robert Ragsdale, Edward Ragsdale and Catherine Ragsdale and defendents William Ragsale, Moses C. Ragsdale, Elizabeth Pool, and Martha Norris -- and Joshua and Letitia Ragsdale who died shortly after their father intestate unmarried and without issue. The said Edward died the owner of a tract of land in said County of Williamson containing upwards of 800 acres, several slaves and other personal property, and letters of administration upon his estate were granted by the County Court of Williamson County to his widow the said Penelope Ragsdale and one Abram White since deceased. On the 20th day of January 1823 four of the said children of Edward Ragsdale dec'd to wit your orators Edward & Robert & Henry Ragsdale, and the defendent William Ragsdale being then minors filed their Bill of complaint in this court by their guardian Spenser Buford against the said Penelope Ragsdale and Abram White the administrator and administraion of said Edward Ragsdale dec'd and said Coldwell P. Pool and Elizabeth his wife and George D. Norris and Martha his wife and your orators Catherine Ragsdale praying for an account of the administration and an allotment of dower and division of land & negroes & other property, money & c. in the hands of the administrators Notice was answered by the said Norris's wife and Pool's wife and they became regular parties to said suit; your orators state that such devices were _____ in said suit and suit proceedings had therein, that _____ was assigned to the widow, and the balance of the land & negroes & other affects divided among the children of said _____. An account was taken of the administration, and a final settlement thereof had _____ herein after stated. Your orator states that appears from said suit that proceeds to that settlement the said Penelope Ragsdale had advanced to the said Elizabeth Pool various sums of money in the way of board, clothing, education and other items ____ which said Pennelope was credited in said account, exceeding the value of the share of said Elizabeth in the personal estate of her father by the sum of $92.83 and the final decree rendered in said case on the 30th day of April in the year 1829 (?) it was among other things decreed that said Pool and wife pay to the other distributees $92.83 in equal proportions. The said Norris & wife had also received largely more than their share of the personal estate, and the said decree were in like _____ decreed to pay back such surplus for the use of the other distributees. Your orators charge that _____ of these as such distributees is entitle to a share or portion of said sum of $92.83 with interest since the 30th April 18_9 [smudged]. _____ said Pool & wife at the resolution of said suit were not residents of the State of Tennessee and have so continued to reside out of this state ever since, and have at no time since said decree was _____ had any property or effect in this state out of which payment of daid debt could have been enforced, at least not within their knowledge and the same remains wholly unpaid and the said Pool & wife have had the benefit of, and enjoyed the use of much more than theri share of the estate of said Edward Ragsdale, deceased, and refuse to pay to your orators their ______ portion thereof.

The said Penelope Ragsdale recently died in said county of Williamson and your orator William White has been appointed administrator upon her state by the county court of Williamson aforesaid, and has taken into his possession the personal estate of said Penelope in toto consisting in part of slaves Mary, about 60 years old, and Charity about 15 years old, and a claim to an interest in a slave named Rachel & her two children Mariah and Dianah, and some other personal effects. The whole being as he now calculates much more than sufficient to pay all the debt of his intestate, expenses of administration. The said Penelope left ___ ______ as the distribution of her personal estate, her said children -- Henry, Robert, William, Moses C., and Catherine Ragsdale and Elizabeth Pool and Martha Norris and at the final settlement of the accounts of your orator as administrator the said Pool & wife will be entitled to a share thereof as part of the distribution of said Penelope Ragdale deceased.

The tract of land which was allotted to the said Penelope as her dower was never____ divided among the heirs of said Edward Ragsdale deceased and the said Elizabeth Pool is entitled to one individual eighth part thereof in value said dower tract is situated in said county of Williamson and contains 105 1/11 acreas bounded as follows . . .

Your orators say that no process at law can be ______ on said Pool & wife and they pray that said William Ragsdale, Moses C. Ragsdale Coldwell P. Pool and Elizabeth his wife and George D. Norris and Martha his wife may be made defendents to this suit and compelled to answer all allegations therrein contained as fully as if the same were repeated in the form of interrogation. ____ the original title and interest of said Coldwell P. Pool and Elizabeth his wife in and to said tract of land, and slaves and the _____ which may _____ in the _____ of your orator White upon a general settlement of his accountss may be attached. ______ to the negroes of given orator White as ______ administrator and that said Pool _____ be injoined from selling, assigning or transferring their interest in said lands, slaves and _____ in the hands of said administrator. That said Pool and wife be restriained from having or taking any shar or portion of said land or its proceeds if sold until they make your orator equal to themselves in the estate of said Edward Ragsdale deceased by paying them their share of said sum of $92.83, and if necessary that their interest in said land be sold or the whole tract sold and their share of the proceeds applied to the payment of your orators shares of said sum of money with the _____ therein and that the interest of said Pool and wife in the slaves aforesaid are in the surplus in the hands of the administrator White be in the names applied to the payment of said shares and if necessary that the slaves be sold and their shares of the proceeds applied as aforesaid.

Your orators pray process of Allotment and Injunction may issue and a subpoena for said William Ragsdale and an order of publication for the other non-resident defendents and for such other and further and different releiif as the nature of the case may require as is duty, & c.
